Prayagraj: Allahabad High Court has directed the police to provide security to couples living in live in relationship in which one is a transgender woman. The bench of Justice Soumitra Dayal Singh and Justice Donadi Ramesh, hearing the petition filed in the name of J and M, said that living with a person of one’s choice is included in the fundamental rights of a citizen.
The division bench said that the diversity of perception and personality arising from the basic structure of human beings motivates different human beings to make different choices. Even if they are in similar circumstances. Therefore the right to free choice is the soul of freedom and the most beloved and prominent feature of any free society. The petition said that because of ‘J”s gender identity, his liberty, dignity and security from his close relatives are in danger. In the petition, M’s father was accused of verbal and physical assault against J.
The Court said that when a society prevents its members from asserting their individuality within the limits of existing laws, it hinders the process of its own development. In this case the petitioners’ fundamental right to life and liberty requires free choice and protection of their dignity. The court has directed to provide security to the petitioners.
