Dalit woman judge sought leave, Jharkhand High Court made ‘adverse remarks’ in ACR — Supreme Court issued notice!

Allegation of adverse remarks being recorded after filing a petition in the Supreme Court against denial of child care leave. New Delhi: The Supreme Court on Wednesday issued a notice to the Jharkhand High Court. This notice has been issued on the latest application filed by a Dalit woman judge, in which she has alleged that adverse remarks were made in her Annual Confidential Report (ACR) after filing a petition in the apex court against not getting childcare leave. A bench of Justice Prashant Kumar Mishra and Justice Manmohan recorded the argument of senior advocate A.K. Sinha, who appeared on behalf of the Jharkhand High Court. He told the court that as per the suggestion given by the Supreme Court on June 6, the High Court has now decided to grant 92 days of childcare leave to the woman judge. However, the counsel appearing for the judge raised serious concerns before the bench and said that the adverse remarks were made in the ACR only after the petition was filed on May 23. The judge’s counsel said, “One more thing is very disturbing. Some remarks have been made in my ACR now, which have been made after the filing of this petition. I am an officer from the Scheduled Caste category and I have disposed of a large number of cases.” He also said that the judge concerned is “one of the best performing officers.” The counsel questioned the timing of the ACR remarks and said, “Please look at the timing…” To this, the Supreme Court directed the Jharkhand High Court administration to file a reply to the allegations levelled by the judge that adverse remarks were made in his ACR after the petition was filed. Rahul moves HC to challenge order for personal appearance before Chaibasa court

Ranchi: The leader of the opposition in the Lok Sabha, Rahul Gandhi, moved the Jharkhand high court on Monday to challenge an order passed by the special MP/MLA court in Chaibasa which asked his personal appearance in a defamation case. Gandhi was ordered to appear in person before the court on June 26 in connection with the case filed by petitioner Pratap Kumar. Kumar said Gandhi’s statement against BJP leaders, particularly Union home minister Amit Shah, at a political rally in Chaibasa in 2018 was derogatory. Challenging the lower court’s order, Gandhi said he has already moved a petition seeking exemption from appearance before the Chaibasa court at this stage of the case. The petition is also pending before the high court for adjudication, Gandhi’s petition said. The lower court at Chaibasa was informed about the pending petition before the high court, stating that it not been decided on merits. Despite this fact, the lower court refused to grant reprieve to Gandhi and ordered him to appear in person. In his political speech during the last election campaign, Gandhi reportedly referred to Shah as a “murderer”. Gandhi’s statements were defamatory and made purposely to malign the image of Shah, Pratap Kumar said in his petition before the Chaibasa court. Hemant govt must take initiative for OBC reservations in edu institutions: Cong

Jamshedpur: The ruling alliance party, Congress, has appealed to the Hemant Soren govt to take the initiative for the Other Backward Classes (OBC) reservations in educational institutions across the state. Making the appeal, state Congress in-charge Koppula Raju said Article 15 (5) of the Constitution allows the state to make provisions for the betterment of socially and economically backward classes, concerning their admission to educational institutions. While speaking at the Samvidhan Bachao Rally at Sakchi on Sunday, the Congress leader said the state govt must take the initiative without any delay. Raju also said party leader Rahul Gandhi played a pivotal role in driving the Narendra Modi govt at the Centre to give its nod for the caste census. “From the streets to Parliament, Rahul Gandhi fought for the rights of the OBC community which forced the Modi government to bow before the legitimate demand and agree to a census of the backward classes,” Raju said, addressing the crowd at the Sakchi parking zone. Stating that protecting the Constitution is the responsibility of all Indians, Raju further said, “Congress has taken the lead but it is the responsibility of all citizens to participate in the campaign to uphold the democratic values, principles and constitutional provisions.” During the rally, the party passed a resolution praising the armed forces for their commendable feat in ‘Operation Sindoor’. The bravery and courage demonstrated by the soldiers ensured a strong military response to Pakistan, he added. Speaking on the occasion, state Congress president, Keshav Mahato Kamlesh, said the Modi govt failed to align with the spirit of the Constitution, claiming that it was grossly undermined by the Centre with its activities in the last 11 years. The rally was necessitated to make the common people know how the Modi govt is violating the Constitution, Kamlesh said.
