Gonda News: Principal convicted in Dalit murder case dismissed

Gonda. The District Basic Education Officer has dismissed the headmaster who was punished for the murder of a Dalit 26 years ago in Tarabganj police station area. Departmental action was taken after Pradhan’s complaint, evidence and consent of DM, CDO and legal opinion of DGC (Criminal).
After this the order of dismissal of the teacher was issued. The dismissed teacher has said that he will file a petition in the High Court against the departmental order.
Venkateshwar Kumar Pandey, head of village Jamtha of Tarabganj tehsil area, had complained to the District Magistrate along with the notarized affidavit of 22 other people. It said that on December 8, 2010, the court had sentenced Shiv Kumar Singh, the headmaster of primary school Jamtha (Composite), to life imprisonment for the murder of a Dalit person in 1997.
After filing the appeal, he got bail from the High Court and without postponing the execution of the judgment order, reinstatement in service and payment of salary for the period spent in jail etc. is illegal. District Magistrate Neha Sharma nominated the District School Inspector and the City Magistrate to investigate the matter.
Both the officers conducted a detailed investigation and in the report sent to the District Magistrate said that the punishment of Principal Shivkumar Singh has not ended. Only the fine has been halved.
The appeal filed in the High Court against the punishment is still pending, while the UP Basic Education Teacher Service Rules provide that a convicted person will not be eligible for service.
During the investigation, Principal Shivkumar Singh also presented his side and said that an appeal has been filed in the Lucknow bench of Allahabad High Court against the court’s sentence.
When the investigation team informed the District Magistrate about the facts of the case, he ordered to take legal opinion from the Government Advocate (Criminal).
According to the government advocate, if an employee punished in the court on the basis of any criminal charge has filed an appeal in the High Court, then he can be removed from the post even without waiting for its decision.
There is no need for any investigation for this. After this the District Magistrate ordered action.
District Basic Education Officer Premchandra Yadav has issued an order dismissing Principal Shivkumar Singh from service.
He said that this order will be subject to the final decision passed in the criminal appeal Sumer Kumar Singh and others vs. Uttar Pradesh Government and others in the Lucknow bench of Allahabad High Court.
