Case pertains to illegal detention of domestic worker on a trumped-up charge of stealing gold necklace from her employer’s house The State Police suspended another officer attached to the Peroorkada police station in connection with the illegal detention of Nedumangad native Bindu R., a Dalit woman and domestic worker, on a trumped-up charge of stealing a gold necklace from her employer’s house. The complainant had also accused him of harassing her and hurling abuses. She also alleged that the officer had asked her to drink water from the washroom when she asked for water. The disciplinary action comes two days after Peroorkada sub-inspector Prasad S.G. had been suspended, pending inquiry, in connection with the incident. Dragged by Hair, Clothes Torn: Dalit Woman Brutalized in Bhagalpur Police Raid – No Female Officers Present

Dalit residents allege caste-based abuse, assault on women and minors, and illegal detention by male police officers during a late-night liquor raid in Nathnagar. Bhagalpur, Bihar— A police raid conducted by Lalmatiya police station in the Nathnagar Pasi Tola area of Bhagalpur district has triggered massive outrage among the local residents. Villagers allege that during the raid, which took place around 8 PM on Sunday night, police officers assaulted women, children, and men without any justification. Rajni Bharti, a resident of the locality who now lives in Delhi, told The Mooknayak, “My mother has a fractured leg, and my sister Jyoti Bharti (52) had gone to look after her. That night, the police raided our neighborhood and began beating up women and children. When my sister stepped outside and protested, the police dragged her away and assaulted her.” “All the officers—from the inspector to the sub-inspector—are from the Bhumihar caste. They hurled vulgar abuses at the women. When my sister asked them to stop, they became furious and said, ‘How dare people from a lower caste question us?’ About an hour later, they returned, grabbed her by the hair, dragged her to the police station, and kept her in custody all night. Her clothes were torn, and she was left almost naked,” Rajni further alleged. Rajni also mentioned that her house is in the same area where the police carried out the raid, although she currently resides in Delhi. “My brother informed me about the incident. The police have now filed an attempt-to-murder case against my sister. Is this how you treat an elderly woman—by humiliating her and dragging her to the police station simply because she questioned them for beating women and children? She is still in police custody. Around 15–20 people were arrested, all of them from the Dalit community,” she added. Gunjan Kumari, a minor who was present during the raid, tearfully recounted to a journalist that she saw a police officer kick her mother multiple times. Her emotional breakdown while narrating the incident reflects the trauma inflicted on the community. Notably, no female police officers were present during the raid. All actions were carried out by male officers, which has fueled further anger, particularly due to the allegations of manhandling and verbal abuse of women. Prema Devi, who was injured during the police action, stated, “They forcibly broke into our home and beat everyone. I was hit with batons two or three times. My brother-in-law was beaten so severely that his leg is broken.” Even bystanders weren’t spared. Ashok Chaudhary, who was standing at his grocery shop, said he suffered injuries to his hand due to police beating, despite having no connection to the incident. Bhagalpur City DSP-2, Rakesh Kumar, addressed the media and stated, “The raid was conducted at the residence of Ravi Chaudhary in Pasi Tola following a tip-off about liquor storage. When the police arrived, the family members allegedly pelted stones at the officers, resulting in minor injuries to three of our personnel.” When journalists asked the DSP whether public anger erupted after a girl was slapped by the police during the raid, he avoided a direct response and said, “I do not have information about that.” Courtesy : Rajan Chaudhary, The Mooknayak Note: This news is originally published on https://themooknayak.com/ and is for use by the non-military/non-commercial community, especially those in the human rights sector.
Dalit woman stripped and searched in police station, asked for water and got toilet water! — Serious allegations against Kerala police

A 39-year-old Dalit woman from Kerala has made serious allegations of inhumane treatment, stripping and searching and mental harassment in police custody. The FIR in the case turned out to be false, but the action is still incomplete. Thiruvananthapuram — A 39-year-old Dalit woman Bindu was not only arrested on false charges of theft in Kerala’s capital Thiruvananthapuram, but also had to face inhumane mental torture in police custody. After this case came to light, there has been a stir in the state politics and the opposition has launched a scathing attack on the Chief Minister’s Office (CMO) and the police department. False allegation of theft and harassment in custody Bindu, who is a domestic worker and hails from Chullimanoor, was accused by her employer of stealing a gold chain on April 23. Based on this complaint, the Perurkada police called her and called her to the police station. On reaching the police station, the victim repeatedly said that she was innocent, but the police did not listen to her. According to Bindu, a woman police officer took her to a room, made her remove her clothes and searched her. Then the police took her to her house and searched there too. During this time she was not allowed to talk to the family, nor was she given food and water. Bindu told the media, “When I asked for water, a policeman said – ‘Go to the toilet and drink from there’.” Detained overnight, threatened to implicate daughters Bindu said that she was kept in the police station all night and the interrogation continued till the next morning. An FIR was registered and the police threatened her that if she did not confess to the theft, her minor daughters would also be implicated in the case. Later when the mistress of the house and her daughter reached the police station again, they said that they had been ‘forgiven’. After some time it was found that the stolen gold chain was found in the house itself, and the complainant herself admitted that the allegation was false. Complaint ignored in CMO When Bindu gave a written complaint to Chief Minister’s political secretary P. Sasi with the help of a lawyer, she claims that Sasi neither read the complaint nor gave any assurance. “He said that this is a common thing and advised me to go to court,” Bindu said. However, the CMO later clarified that the police were directed to take action after receiving the complaint. But according to Bindu, she had also requested the CMO to register a case against the woman who falsely accused her, which was rejected. Opposition and social organizations’ outrage Opposition leader V.D. Satheesan condemned the incident, saying, “This is not just an isolated incident but an example of injustice meted out to Dalits by the ruling system. Strict action should be taken against the guilty police officials.” Former Home Minister Thiruvanchoor Radhakrishnan called it “inhuman” and said that such incidents should have no place in a progressive society. Congress state president Sunny Joseph and AIDWA (All India Democratic Women’s Association) national president P.K. Srimathi also condemned the incident. “No woman should be treated like this. This is an example of police brutality,” Srimathi said. Policeman suspended, BNSS law violated An inquiry conducted by Police Commissioner Thomson Jose revealed that several procedural lapses were committed in Bindu’s arrest. The inquiry found that the police violated the provisions of the Indian Civil Security Code (BNSS) – which prohibits arresting women after sunset and before sunrise, unless with the permission of a magistrate. The police neither informed her family about the arrest nor gave any explanation in court as to why the arrest was necessary in an emergency situation. Based on these serious lapses, sub-inspector SG Prasad of Perurkada police station has been suspended and an inquiry is underway against other responsible officers. Demand for justice Bindu has filed complaints with the chief minister, the state police chief and the Scheduled Caste Commission and is now preparing to move court. She said the police not only discriminated against her on the basis of caste but also physically and mentally tortured her. Bindu said, “I have identified some policemen. I will go to court. I want justice.” Courtesy : Rajan Chaudhary, Hindi News
Kerala: SI suspended for detaining, mentally harassing Dalit woman falsely accused of theft

The woman was detained at the police station for about 20 hours and denied food and water; another cop, Prasannan, is said to have harassed the woman the most but no action against him has been taken yet. THIRUVANATHAPURAM: A police sub-inspector attached with Peroorkada station has been suspended for mentally harassing a dalit woman, who was taken into custody on a complaint of theft, which was later proved to be false. S G Prasad was suspended on the basis of an adverse report filed by the Special Branch Assistant Commissioner, who had probed the incident on the instruction of the City Commissioner. Bindu R, who hails from Panavoor near Nedumangad, was working as a house maid at Ambalamukku when she was detained by the cops on the complaint of the house owner claiming that 20 grams of gold ornament had gone missing from house. The police detained the 39-year-old for about 20 hours where she was even denied drinking water. Her ordeal ended when the complainant found the gold, which was misplaced in her house, and conveyed it to the police. The police withdrew the FIR against the woman, but the incident snowballed into a major controversy after the victim complained with the Police Complaints Authority, SC/ST Commission and the CM’s Office. The Special Branch report said lapses from the police side were evident. It said the woman was kept in custody at odd hours without prior authorisation and the entire episode contravened existing legal conventions. Meanwhile, Bindu said though she was contended with the action against the SI, another cop named Prasannan who had harassed her the most was still untouched and that she wanted action to be taken against him. At least 15 people were injured in a stampede-like situation during a music programme conducted by Malayalam rapper Vedan at Kotta Maithanam (fort ground) in the Palakkad district of Kerala on Sunday, 18 May. The incident occurred on Sunday evening as an uncontrollable crowd surged forward, forcing police to resort to a lathi-charge multiple times to bring the situation under control. The event, jointly organised by the Scheduled Castes and Scheduled Tribes Development Department and the Culture Department, had drawn a crowd of over 2,000 people. The programme, which was scheduled to start at 6 pm, began two hours behind schedule, further agitating the waiting audience. Scuffle and stampede-like situation As Vedan took the stage around 8 pm and began his first song, the crowd broke past the barricades set up for security, leading to a scuffle and a stampede-like situation. Several people suffered minor injuries, and some in the audience reportedly fainted due to the chaos. Police initially attempted to control the crowd but were soon overwhelmed by it. A team led by Additional Superintendent of Police (ASP) Rajesh Kumar arrived at the spot and temporarily halted the programme to clear pregnant women, the elderly, and children from the venue. Despite attempts to restore order, the unrest persisted. The police were forced to lathi-charge the crowd four times during the event. Tensions flared further as a scuffle reportedly broke out between the police and organisers during the commotion. Kerala Police initiates inquiry into alleged custodial harassment of Dalit woman at Peroorkada police station

While the woman was booked under Section 306 (theft by a clerk or servant) of the BNS, it is now deemed that the accusation was false The Kerala Police have instituted an inquiry into the alleged custodial harassment of a Dalit woman at the Peroorkada police station after being falsely accused of theft. Bindu R., a domestic worker and mother of two children, was taken into custody on April 23 after a complaint was filed by her employer, alleging that she had stolen 2.5 sovereigns of gold. While she took up the job at the house in Ambalamukku on April 14, she worked only for three days until April 19 before discontinuing. She was purportedly called to the police station around 3.30 p.m. and “detained” for nearly 20 hours. During her time at the station, Ms. Bindu alleges she was subjected to inhumane treatment, including being told to drink water from the washroom when she asked for water. She claims the officers coerced her into confessing to the theft by threatening to implicate her two minor daughters, and her husband in the case. Despite a search of her residence yielding nothing, she was booked under Section 306 (theft by a clerk or servant) of the Bharatiya Nyaya Sanhita (BNS). She also alleged that she spent the night at the police station and was denied food until the following afternoon. The accusations eventually unravelled when the complainant informed the police that the missing gold necklace had been found at their own residence. Ms. Bindu has since filed formal complaints with the Chief Minister, State Police Complaint Authority and the State SC/ST Commission. The Commission has initiated an inquiry and has instructed the Thiruvananthapuram City Police to submit a report in this regard. Seeks action against cop Leader of Opposition V.D. Satheesan called for strict legal action against the officers involved in the issue. He also criticised the perceived inaction of the Home department in redressing the complainant’s grievance. He further alleged that the absence of accountability in the department and the political patronage of law enforcement enables such abuse of power. He said that the conduct of the police officers amounts to gross violation of human rights and the law. ‘They Would Have Abused Vyomika Singh Too if They Knew She was a Dalit’: Senior SP Leader’s Dig at BJP

Ram Gopal Yadav took a dig at the BJP after its minister Kunwar Vijay Shah referred to Colonel Sofiya Qureshi as “sister of terrorists.” New Delhi: On the backfoot after one of its ministers in Madhya Pradesh made communally-laced derogatory remarks about Colonel Sofiya Qureshi, the Bharatiya Janata Party (BJP) on May 15 tried to shift the optics by rallying against senior Opposition leader Ram Gopal Yadav of the Samajwadi Party after he targeted the saffron party by referring to the caste backgrounds of the officers involved in the Operation Sindoor. Addressing a public meeting in Moradabad on Thursday, Yadav – a Rajya Sabha Member as well as the national general secretary of the SP – took a dig at the BJP after its minister Kunwar Vijay Shah referred to Qureshi as “sister of terrorists.” For his controversial remarks, Shah earned the censure of the MP High Court, which ordered police to register an FIR against him for further action. Yadav first criticised the BJP for launching nationwide Shaurya Tiranga Yatras to celebrate Operation Sindoor even as infiltration incidents continued in Jammu and Kashmir. “Terrorists are getting killed daily. They are coming from Pakistan. And they (BJP) are taking out a Tiranga Yatra. They are doing this only for elections,” said Yadav. ‘Had they knew the caste of other officers, they would have hurled abuses at them as well’ The senior SP leader then referred to the MP High Court ordering an FIR against Shah. He alleged that had the BJP known about the background of wing commander Vyomika Singh and air marshal A. K Bharti, its leaders could have insulted them too like they did with Colonel Qureshi, a Muslim. “They didn’t know what Vyomika Singh’s caste was nor did they know about air marshal Awadhesh Kumar Bharti. Otherwise, they would have hurled abuses at them too,” said Yadav. The SP leader then went on to talk about the caste background of Vyomika Singh and A.K Bharti. “Let me tell you – Vyomika Singh is a ‘Jatav Chamar’ from Haryana, and Air Marshal Bharti is a Yadav from Purnia. All three were from the PDA (Pichda, Dalit, Alpsankhyak),” said Yadav. The PDA refers to the electoral strategy of SP chief Akhilesh Yadav – Ram Gopal Yadav is his uncle – of mobilising backward castes, Dalits and minorities, especially Muslims, against the BJP’s Hindutva agenda. Jatav is a Dalit community while Yadav is an Other Backward Classes (OBC) community. Yadav further said that while one (Qureshi) was abused because the BJP knew she was a Muslim, they did not say anything about Vyomika Singh assuming her to be an ‘upper caste’ Rajput. About A.K Bharti, they had no information whatsoever, added Yadav. The BJP, left red-faced by Shah’s remarks against Colonel Qureshi, launched an attack against Yadav accusing him of insulting the armed forces by viewing it through the lens of caste. “The uniform of the army is not seen through a ‘casteist lens’. Every soldier of the Indian army performs ‘national duty’ and is not a representative of any caste or religion,” said UP Chief Minister Yogi Adityanath. BJP attacks SP over Yadav’s statement Targeting Yadav, Adityanath said that the SP leader’s “act of binding a brave daughter within the ambit of caste” was “not only a display of his party’s narrow-mindedness” but was also “a grave insult to the valour of the army and the country’s identity.” “This is the same mentality which dares to divide even patriotism in the name of appeasement and vote bank politics,” said Adityanath. BJP’s Uttar Pradesh president Bhupendra Chaudhary said Yadav’s “casteist statement” on wing commander Vyomika Singh, “the daughter of the country who broke the morale of terrorists and Pakistan, is not only reprehensible but is also a gross insult to the amazing courage, bravery of the army and the identity of Mother India.” “Ram Gopal Yadav has probably forgotten that by successfully completing Operation Sindoor, the daughter of the country has done the unique work of making Mother India’s pride and glory known to the entire world, which is amazing and admirable in itself,” said Chaudhary. Bahujan Samaj Party chief Mayawati, herself a Jatav Dalit, criticised both Yadav and the BJP for their “shameful and condemnable” remarks. “The entire country is united and proud of the valour of Operation Sindoor of the Indian Army against the terrorists in Pakistan. In such a situation, it is extremely unfair to judge and divide the army on the basis of religion and caste,” she said. UP: Former Congress Seva Dal leader sentenced to life imprisonment for raping Dalit woman

Dalit woman fought for justice for 7 years, court convicted Congress leader Achhan Khan and sentenced him to life imprisonment Lucknow: A special court in Ambedkar Nagar on Saturday sentenced former Congress Seva Dal official Achhan Khan (50 years) to life imprisonment for raping a Dalit woman – who was his colleague. The court also imposed a fine of Rs 22,000 on the accused. In case of not paying the fine, he will have to undergo an additional imprisonment of three months. Special Judge (SC/ST Act) Ram Vilas Singh convicted Achhan Khan under sections 376 (rape), 506 (criminal intimidation) of the IPC and sections of the Scheduled Castes/Tribes (Prevention of Atrocities) Act. This verdict comes almost seven years after the incident when the first complaint of sexual harassment was lodged. According to Special Public Prosecutor Sudeep Mishra, the victim, who was a grassroots worker of the Congress, alleged that Achchan Khan barged into her house on the evening of September 12, 2018 and raped her. The victim told the court that the accused, who knew her from party work, physically grabbed her, used casteist slurs and threatened to kill her if she told anyone. The victim said she pleaded for justice — lodged a complaint at the Akhbarpur police station and also approached the then Superintendent of Police — but no action was taken. Neither an FIR was registered, nor was a medical examination conducted. The woman also alleged that on September 17, 2020, Achchan Khan called her to Haria area in Basakhri police station area and raped her again. This time, the accused took objectionable photographs of her and threatened to make them viral on the internet if she approached the law. The victim says that one such semi-nude photo was in fact circulated on social media, causing further mental trauma to her. Frustrated by the police’s continued negligence, the victim sent a registered complaint to the Ambedkar Nagar SP on October 31, 2020, but received no response. She then approached the local court, which directed the Basakheri police to register an FIR. The case was registered on September 20, 2021, and the chargesheet was filed on January 28, 2022. Public Prosecutor Mishra said, “The victim’s detailed and consistent testimony in court formed the strong basis of the prosecution.” He further said, “Despite the initial negligence of the police, we ensured a conviction on the basis of her testimony and available evidence.” The court also observed that the delay in the police not taking the complaint seriously did affect the investigation, but it did not affect the credibility of the victim.
