Maharashtra News: Maharashtra Administrative Tribunal has asked to bring a ‘clear policy’ within six months on the provision of jobs for the transgender community in Maharashtra.
Job For Transgender Community: The Maharashtra Administrative Tribunal (MAT) recently asked the state government to come out with a ‘clear policy’ on the provision of jobs for transgender persons within six months. The instruction was specifically regarding the police department as the applicant has applied for the post of Police Sub-Inspector (PSI) and has to undergo a specific physical test. The panel asked the concerned departments in the state to file affidavits on the steps taken to implement the 2014 Supreme Court judgment, which said it would consider transgender persons to be Socially and Educationally Backward Classes of Citizens (SEBCs). This petition was made by a transgender candidate
Types of reservation for admission in educational institutions and for public appointments. The petition cited the verdict and sought reservation of posts for transgender persons in the recruitment of 800 posts in the disputed advertisement. MAT chairperson Justice Mridula Bhatkar along with a member Medha Gadgil was hearing an application on August 1 by an applicant who claimed to be transgender and asked the Maharashtra Public Service Commission (MPSC) to allow her to apply for the post of PSI. Instructions were sought for granting permission. As stipulated in the June 23 advertisement as a transgender candidate. The applicant also prayed for reservation of posts for transgenders.
Candidate got permission for preliminary examination
Advocate Kranti LC submitted that the applicant was male by birth but later opted for female gender, and hence applied for the post as a transgender candidate as the option for the same was provided by MPSC. The applicant also sought to be considered as a female candidate. MPSC said that the applicant will be allowed to appear for the preliminary exam which is going to be held on October 8. The counsel for the applicant referred to the Supreme Court judgment of 2014 in National Legal Services Authority vs Union of India, which recognized several rights of the transgender community. The top court had ordered states to reserve certain seats for transgender persons in government jobs. The applicant said that according to the Constitution, discrimination cannot be done on the basis of gender.
